Many couples who married in Chennai now live in different countries. Divorcing across borders can be done efficiently, but decisions about where and how to file have long-term consequences, especially for property and children.
Filing in India or abroad?
An Indian court can usually hear the divorce if the marriage was solemnised in its area, the respondent lives there, the couple last lived together there, or the wife (as petitioner) now lives there. Under Section 19 of the Hindu Marriage Act, a petitioner in India can also file where they live if the respondent lives outside India.
A divorce granted abroad is not always recognised in India. In Y. Narasimha Rao v. Y. Venkata Lakshmi (1991), the Supreme Court held that a foreign divorce decree is generally recognised only if it was granted on a ground available under the law under which the parties married, with proper jurisdiction and participation. A foreign decree that doesn't meet these conditions may leave you still married under Indian law.

Frequently asked questions
Do I need to travel to India for my divorce?
Not always. In mutual consent cases, courts increasingly allow appearance by video conference, and a power of attorney holder can handle many procedural steps. Some courts may still require at least one personal appearance.
Is my foreign divorce valid in India?
It depends on how and why it was granted. A foreign decree based on grounds not recognised under the Indian law of your marriage, or obtained without your participation, may not be recognised. Get advice before remarrying.
Can a power of attorney holder file for divorce on my behalf?
A power of attorney holder can assist with filing and procedure, but your consent and statement must still be given by you personally, often by video.
What about our child who lives abroad with my spouse?
Custody involving another country is complex and may involve the courts there as well. We advise on the Indian options and work with your overseas lawyer.
